this may sound stupid but have you tried going into menu/settings and playing with picture settings? im sure theres something wrong but maybe you can get it looking better.
Have you tried asking them? Is it actually marked faulty or just cheap??

Other than that, it might be panel config or contrast/brightness set wrong.

Well the 60 inch tom66 help me fix stumped the last guy i bought it from so i would not necessarily say it will stump you. I think its more like this if the guy can afford a 40 inch for his kids, he most likely does not feel the worth of fixing it, and will just replace it, after all he has the extra cash to blow on things like that for his kids, further more i am betting money that the kids messed with settings because that's what kids do, i got a used 27 incher for my kids and put it up high so they can't get to it because i cannot afford accidents, and i got a deal on it. and if it breaks i will go the extra mile to fix it cause i am poor LOL. so that's more likely whats going on in my opinion....
Looks like the T-con to me. I fixed the 46 inch version of this set. Over saturated on the reds in my case and reseting the picture to factory defaults did not improve it. Replacing the T-can fixed it.
